I, ____________, residing at ____________ (the “Principal”), hereby appoint ____________, residing at ____________, as my attorney-in-fact (“Agent”) to act for me and in my name in any way I could act in person with respect to the powers granted below.
I grant my Agent full power and authority to act for me, in my name and for my benefit, in each of the following matters:
(a) Real Property Transactions. To buy, sell, exchange, lease, mortgage, encumber, manage, insure, and otherwise deal with any interest in real property, and to sign, deliver, and record deeds, mortgages, leases, and other instruments relating to real property.
(b) Banking and Financial Transactions. To open, maintain, and close accounts at banks and other financial institutions; deposit and withdraw funds; write and endorse checks; access safe deposit boxes; borrow money; and manage certificates of deposit, brokerage accounts, and other financial assets.
This Power of Attorney is DURABLE. It shall not be affected by my subsequent disability or incapacity, and my Agent's authority shall continue notwithstanding any lapse of time, my disability, or my incapacity, until my death or my revocation of this instrument.
This Power of Attorney is effective immediately upon my execution of it and shall remain in effect until revoked or terminated as provided in this instrument.
My Agent shall act in my best interest, in good faith, and only within the scope of the authority granted in this instrument. My Agent shall keep complete and accurate records of all receipts, disbursements, and transactions made on my behalf, and shall keep my property separate from the Agent's own property. My Agent shall not use my property for the Agent's own benefit, make gifts of my property to the Agent, or engage in any other act of self-dealing, except as I have expressly authorized in the Special Instructions above.
Any third party who receives a copy of this instrument may rely on it, and may act in reliance on the authority of my Agent, until the third party receives actual notice of revocation or termination. I agree to indemnify and hold harmless any third party who acts in good-faith reliance on this Power of Attorney. A photocopy or electronically transmitted copy of the signed original shall have the same effect as the original.
I may revoke this Power of Attorney at any time by delivering written notice of revocation to my Agent and to any third party known to be relying on it. This instrument revokes any prior general financial power of attorney I have executed. This Power of Attorney terminates upon my death or my revocation.
This Agreement shall be governed by and construed in accordance with the laws of the State of ____________, without regard to its conflict-of-laws principles.
Most states require a power of attorney to be signed before a notary public, and some states also require one or two adult witnesses. Do not sign this document until you are in the presence of a notary (and witnesses, if your state requires them). Sign exactly as your name appears above. Give the signed original or a copy to your Agent, and consider providing copies to your bank and other institutions your Agent will deal with.
