This Residential Lease Agreement (this “Lease”) is entered into as of ____________ by and between ____________, with a mailing address of ____________ (“Landlord”), and ____________ (“Tenant”). Landlord and Tenant may be referred to individually as a “Party” and together as the “Parties.”
Landlord leases to Tenant, and Tenant leases from Landlord, the dwelling located at ____________ (the “Premises”), for use as a private residence only. No parking is included with the Premises. Only Tenant may reside at the Premises without Landlord's prior written consent.
The term of this Lease begins on ____________ and ends on ____________ (the “Term”). If Tenant remains in possession after the Term with Landlord's consent, the tenancy converts to month-to-month on the same terms, terminable by either Party on 30 days' written notice.
Tenant shall pay rent of $____ per month, due in advance on the 1st day of each calendar month. Any payment returned for insufficient funds shall be treated as unpaid rent, and Landlord may require a certified payment method thereafter.
Upon signing this Lease, Tenant shall pay a security deposit of $____, to be held and returned by Landlord in accordance with the law of the State of ____________, including any deadlines for itemized deductions and return. The deposit may be applied to unpaid rent, damage beyond ordinary wear and tear, and other amounts owed under this Lease, and may not be applied by Tenant as the last month's rent.
Tenant shall arrange and pay for all other utilities and services supplied to the Premises, including electricity, gas, internet, and any utility not expressly assumed by Landlord, together with any deposits required by providers.
Tenant shall use the Premises only as a private residence, comply with all applicable laws and any homeowners'-association rules, and shall not disturb neighbors or use the Premises for any unlawful purpose. Landlord covenants that, upon paying rent and performing this Lease, Tenant may peaceably and quietly enjoy the Premises.
Tenant shall keep the Premises clean and sanitary, dispose of waste properly, use fixtures and appliances reasonably, and promptly notify Landlord of any condition needing repair. Tenant shall be responsible for damage caused by Tenant, occupants, or guests beyond ordinary wear and tear. Landlord shall maintain the Premises in habitable condition and make repairs required by law within a reasonable time after notice.
Tenant shall not paint, alter, or improve the Premises, or install locks, satellite dishes, or fixtures, without Landlord's prior written consent. Approved alterations become Landlord's property unless the Parties agree otherwise in writing.
No animals of any kind may be kept on the Premises without Landlord's prior written consent, except properly documented assistance animals as required by law.
Smoking of any substance, including vaping, is prohibited everywhere on the Premises and the surrounding property.
Tenant shall not assign this Lease or sublet all or part of the Premises without Landlord's prior written consent, which shall not be unreasonably withheld. Any approved sublease does not release Tenant from Tenant's obligations under this Lease.
Landlord may enter the Premises to inspect, make repairs, or show the Premises to prospective tenants or buyers, upon reasonable advance notice as required by the law of the State of ____________ (at least 24 hours unless a longer period is required), and at reasonable times. Landlord may enter without notice in an emergency.
If Tenant fails to pay rent when due or breaches any other provision of this Lease, Landlord may deliver any notice required by law and pursue all remedies available under the law of the State of ____________, including termination of the tenancy and recovery of possession. Tenant shall be liable for amounts owed through the end of the Term to the extent permitted by law, subject to Landlord's duty to mitigate where required.
Landlord's insurance does not cover Tenant's personal property. Tenant is encouraged to obtain renter's insurance covering Tenant's belongings and personal liability.
All notices under this Agreement shall be in writing and shall be deemed given when delivered personally, sent by certified mail (return receipt requested) to the addresses stated in this Agreement, or sent by email with confirmation of receipt.
This Agreement shall be governed by and construed in accordance with the laws of the State of ____________, without regard to its conflict-of-laws principles.
If any provision of this Agreement is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
This Agreement constitutes the entire agreement between the parties with respect to its subject matter and supersedes all prior or contemporaneous understandings, agreements, negotiations, and discussions, whether oral or written. This Agreement may be amended only by a written instrument signed by both parties.
This Agreement may be executed in counterparts, each of which shall be deemed an original and all of which together shall constitute one instrument. Signatures delivered electronically (including through a reliable electronic signature service) shall be deemed original signatures for all purposes, consistent with the U.S. ESIGN Act and applicable state law.
IN WITNESS WHEREOF, the parties have executed this Agreement as of the Effective Date, intending to be legally bound.
