A lease termination letter is the written notice that ends a tenancy, sent by either the tenant or the landlord. It fixes three facts on paper: when notice was given, when the tenancy ends, and where the deposit should be sent. Those dates decide whether another month's rent is owed and when the deposit-return clock starts, which is exactly what people argue about after the keys are handed back.
The notice period comes from two places — your lease and your state's landlord-tenant law — and you have to satisfy whichever is longer. Many states also require the notice to line up with the rental period, so a letter sent mid-month may not take effect until the end of the following month. The common mistake is counting from the day the letter is written rather than the day it is actually delivered.
Common questions
How much notice do I have to give to end a month-to-month lease?+
Thirty days is the most common requirement, but a number of states ask for 60 days, and several require a longer period from landlords than from tenants or once a tenancy passes a year. Local rent-control rules can add more on top. Check your lease first, then your state statute, and use whichever period is longer.
Can I break a fixed-term lease early?+
Not on your own — a fixed term binds you for its full length unless the lease has an early-termination clause or the landlord agrees to release you. Most states do require a landlord to make reasonable efforts to re-rent, which limits what you owe after you leave. Active-duty service members have a separate federal right to terminate on deployment or permanent-change-of-station orders.
How should I deliver a lease termination letter?+
Use whatever method the lease specifies. If it is silent, certified mail with return receipt, or hand delivery against a signed acknowledgment, gives you proof of the date. Email alone is risky unless the lease accepts electronic notice. Keep the letter and the delivery receipt together until the deposit is returned.
