About this document
A demand letter is a written request for payment that states the amount owed, the facts behind it, a deadline, and what you will do if the deadline passes. It often works on its own, because it signals that you are organized and prepared to follow through. It is also the document a small-claims judge tends to ask about first, since it shows you gave the other side a chance to resolve things.
Tone does the work here. Keep it factual and unemotional — dates, amounts, and documents — and skip insults and threats. Ask only for remedies you would actually pursue; threatening criminal charges to collect a civil debt is improper and unlawful in some states. Send it by certified mail with return receipt, keep a copy of the letter and the receipt, and note that a demand letter does not pause the statute of limitations on your claim.
Common questions
Do I have to send a demand letter before filing in small claims court?+
Usually not required, though some courts expect it and many contracts require written notice and an opportunity to cure before suit. Send one regardless: it costs a few dollars, resolves a meaningful share of disputes without a filing, and becomes a clean exhibit showing the debt and the date you demanded payment.
How long should I give someone to pay?+
Ten to thirty days is the common range, with fourteen days typical for a personal debt or unpaid invoice. Pick a window that is long enough to look reasonable to a judge and short enough to convey that you mean it. State a specific calendar date rather than a number of days where you can.
Should I send a demand letter by certified mail?+
Yes — certified mail with return receipt requested gives you proof of delivery and the date, which is exactly what you would need later. Send a second copy by regular first-class mail or email at the same time, since some recipients simply refuse certified mail. Keep the signed copy, the tracking record, and the receipt together.
